{"id":13298,"date":"2013-03-05T18:31:27","date_gmt":"2013-03-05T16:31:27","guid":{"rendered":"https:\/\/www.boatbookings.com\/blog\/?p=13298"},"modified":"2015-05-27T20:38:48","modified_gmt":"2015-05-27T18:38:48","slug":"possible-tax-changes","status":"publish","type":"post","link":"https:\/\/www.boatbookings.com\/blog\/2013\/03\/05\/possible-tax-changes\/","title":{"rendered":"Possible Changes to Taxation on Your Luxury Yacht Charter"},"content":{"rendered":"<p>The French VAT application to charters is about to change \u2013 this is due to the Bacino decree, which now specifies that any \u2018pleasure\u2019 charter has to be taxed.\u00a0In France, the VAT to be applied to charters is 19.6% of the charter fee; however this can be reduced, depending on the amount of time the yacht spends in French waters. There can be a 50% VAT reduction based on how long the yacht spends in international waters. So, a charter which starts in France, but spends a certain amount of time in international waters, will only have a taxation of 9.8%.<\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/www.boatbookings.com\/yacht_charter\/cannes_day_charter.php?boattype=1&amp;locations=Cannes&amp;regularity=0&amp;bbr=bblog\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter  wp-image-13308\" title=\"Cannes\" alt=\"\" src=\"https:\/\/www.boatbookings.com\/blog\/wp-content\/uploads\/2013\/02\/IMG_2029-1024x574.jpg\" width=\"695\" height=\"389\" \/><\/a><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-13312\" title=\"Rehab\" alt=\"Rehab\" src=\"https:\/\/www.boatbookings.com\/blog\/wp-content\/uploads\/2013\/02\/Rehab-300x186.png\" width=\"300\" height=\"186\" \/><\/p>\n<p>The application of VAT to charters is currently under discussion, and depends on the boat\u2019s \u2018International Waters\u2019 qualification. To define this qualification, the following criteria have been proposed in order to define the yachts:<\/p>\n<ul>\n<li>&#8211; More than 15 metres in length<\/li>\n<li>&#8211; Registered as a commercial vessel<\/li>\n<li>&#8211; Permanent crew on board<\/li>\n<li>&#8211; Spend more than 70% of its charters in international waters \u2013 this is classed as more than 12 nautical miles from the coast.<\/li>\n<\/ul>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-13314\" title=\"AquaBlueIreland\" alt=\"\" src=\"https:\/\/www.boatbookings.com\/blog\/wp-content\/uploads\/2013\/02\/AquaBlueIreland-300x193.png\" width=\"300\" height=\"193\" \/><\/p>\n<p>A vessel qualified as a \u2018High Sea Vessel\u2019, one that travels in to international waters, will have 0% VAT, whereas a vessel without this qualification will have a payment and recovery system for VAT.<\/p>\n<p><em>These proposals are only proposals<\/em>; they still have to be agreed by French authorities and the European Commission. If accepted, they shall be applied in June 2013.
